Member Referral Program
Rules & Regulations

ELIGIBILITY: The member referral program (“Program”) is open to all MedicAlert members of the Canadian MedicAlert Foundation (“Sponsor”), which members must be individuals legally residing in Canada. All participating members shall be referred to as “Participant(s)”. In the case of those members whose MedicAlert accounts/memberships with Sponsor are managed or controlled by a third party, such as a parent, guardian or trustee, such third party shall be the “Participant” for purposes of this Program.

HOW TO PARTICIPATE – Referrer (Participant): Each member will be provided with a unique referral code (“Referral Code”). The Referral Code may be provided verbally or in written form by a Participant to friends and family. There is no limit to the number of friends and family (“Referred”) to whom the Referral Code can be provided. For each successful referral (i.e. Referred becomes a registered MedicAlert member), Participant will receive a credit of $10 applied to their MedicAlert account. There is no limit to the number of credits which can be earned by a Participant. The credit may take up to 5 – 7 business days to process after successful registration of the Referred.
Participants may not refer themselves under this Program.

HOW TO PARTICIPATE – Referred (New Member): Upon registering to become a new MedicAlert member, the Referred must provide the Referral Code to a MedicAlert representative or online (as applicable) during the registration process to participate in the Program as contemplated herein. If the Referred provides the required Referral Code, Referred will receive a $10 discount off their initial enrollment cost (which consists of their membership and any applicable product). The Referred may only use one (1) Referral Code at time of registration.
Upon successful registration, the Referred will become a new MedicAlert member, and will be provided with their own unique Referral Code to enable them to participate in the Program and refer friends and family to earn referral credits.

4. USE OF MEDICALERT CREDIT(S): Subject to the limitations below, Participant(s) may use their earned MedicAlert credits for: (i) membership renewal; (ii) a new identification order/new products; and (iii) reconciling any outstanding balance in their account. Participant can apply some or all of their earned credits during a transaction. Any balance owing after the application of any credits must be paid using standard payment options.
LIMITATIONS ON USE OF CREDITS: Credits have no cash value. Credits cannot be used for donation purposes, and cannot be applied to previous orders.

DISCLAIMER AND INDEMNITY: Sponsor is solely responsible for the distribution and application of credits/discounts to the Participants/Referred. By participating in the Program, each Participant and Referred agrees to release, indemnify and hold harmless Sponsor and its parent company, affiliates, and subsidiaries and their respective advertising, promotion, and fulfillment agencies, and each such entity’s respective employees, officers, directors, shareholders, agents, representatives, successors and assigns, (collectively, the “Releasees”), from any and all losses, damages (whether direct, indirect or consequential), claims and actions of any kind in connection with, arising from or related to the Program, participation in the Program, disclosure of any Referral Code, or the acceptance, use or application to a MedicAlert account/membership of any credit(s) or discount(s), including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
None of the Releasees shall be liable for any damages whatsoever, whether direct, indirect or consequential, and whether suffered by a Participant, a member, a Referred or a third party, arising from or related to the Program, participation in the Program, disclosure of any Referral Code, or the acceptance, use or application to a MedicAlert account/membership of any credit(s) or discount(s), including without limitation, damages relating to personal injury, death, and property damage, and damages based on publicity rights, defamation, or invasion of privacy.
Except where prohibited by law or otherwise expressed withdrawn consent in writing, by participating in this Program, Participant(s) and Referred hereby expressly consent to the disclosure and/or use of their name, voice, likeness, image, photograph, and/or city/town of residence, without further notice or compensation, on the Canadian MedicAlert Foundation website as well as in any publicity or promotion carried out by the Sponsor or the other Releasees, on a worldwide basis and in all forms of media in perpetuity.

GENERAL RULES: By participating in the Program, Participants and Referred agree to comply with these Program Rules and the decisions of Sponsor, which are final. This Program shall remain in effect for as long as the Sponsor shall decide in its sole discretion. Notwithstanding any other provision herein, Sponsor reserves the right, in its sole discretion, to modify, amend, cancel or terminate the Program or the Program Rules at any time, without notice, and for any reason.

DISQUALIFICATION: None of the Releasees is responsible for lost, incorrect or omitted Referral Codes, interrupted or unavailable network servers or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of this Program or the operation of Canadian MedicAlert Foundation website or any other Sponsor-hosted website, as determined by Sponsor, in its sole discretion, will be disqualified from participating in the Program. Any evidence of fraudulent or questionable activity will immediately disqualify all involved individuals. If a Participant/Referred is disqualified, all credits and discounts earned in connection with this Program will be forfeited. For certainty, if a Participant is disqualified for any of the above abuses, Sponsor reserves the right to disqualify any Referred possessing such Participant’s Referral Code from participating in the Program. In the event any portion of the Program is compromised at any time by a computer virus, bug, non-authorized human intervention or other causes beyond the control of Sponsor which in the opinion of Sponsor corrupts or impairs the administration, security, fairness or proper entry into the Program, Sponsor reserves the right, in its sole discretion, to suspend, cancel or terminate the Program and to award credits or discounts to Participants/Referred up to the point of termination. In no event will more credits or discounts be awarded than those listed in these Program Rules. Furthermore, neither Sponsor (nor any of the Releasees) will be responsible if any factor beyond its reasonable control, including weather, event cancellations, strike, lockout or any other labour dispute at their locations or the locations of any other organization or business whose services are used to fulfill this Program, prevent the credit/discount or any component of the credit/discount from being fulfilled. In any such event, neither Participants nor any Referred will be provided with a substitute value or a substitute component of the applicable credit or discount, except at Sponsor’s sole discretion.

TAX INFORMATION: Credits or discounts earned through participating in the Program may be subject to income tax liability. Any such income tax liability connected with the receipt of credits/discounts is the sole responsibility of the Participant or Referred, as applicable. Any requirement to claim credits is the sole responsibility of the Participant or Referred, as applicable. Participants and Referred must comply with all applicable federal, provincial and local laws. No information contained in this document constitutes, and should not be construed to constitute, tax advice. Each Participant/Referred is encouraged to consult their own tax advisor regarding the tax consequences of earning or receiving credits or discounts pursuant to this Program. No representation is made in this document as to the tax consequences of the Program to any Participant or Referred, including but not limited to the tax consequences of a Participant or Referred receiving credits or discounts. In no event shall any of the Releasees have any liability or responsibility whatsoever for any taxes levied on a Participant or Referred.

APPLICABLE LAWS: This Program is subject to all applicable federal, provincial, territorial and municipal laws. The Program is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

PERSONAL INFORMATION: Personal information of Participants and Referred is collected, stored, used and disclosed for purposes of administering the Program (including the application of credits and discounts and the tracking of Referral Codes), as more specifically set out in the Sponsor’s Privacy Policy, located online at http://www.medicalert.ca/en/help/privacy.asp.
